NoxyAI Terms of Service

Welcome to NoxyAI. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "User"), and NoxyAI ("we," "us," or "our"), concerning your access to and use of the NoxyAI platform.

1. SCOPE OF SERVICES AND DOMAIN COVERAGE

These Terms apply uniformly across our entire network of services, tools, and platforms. This agreement strictly governs your use of the primary domain and all subdomains owned by NoxyAI, explicitly including but not limited to:

• noxyai.com: Our primary consumer AI chat interface and user dashboard.
• dev.noxyai.com: Our developer API platform, documentation, and endpoint generation.
• dino.noxyai.com: Our specialized auxiliary tools and sandbox environments.
• All other current and future subdomains operating under the NoxyAI architecture.

The rules, protections, and restrictions detailed below apply equally to every single page, API endpoint, and interface across this entire domain network.

2. STRICT PROHIBITION ON HACKING AND PLATFORM ABUSE

Please read this section carefully: Do not try to hack us.

We have zero tolerance for malicious activities, cyberattacks, or unauthorized testing. You are strictly prohibited from attempting to compromise the security, integrity, or performance of NoxyAI, its databases (Supabase), or its hosting infrastructure (Vercel).

Prohibited Actions:

You may NOT, under any circumstances:

• Attempt to bypass our End-to-End Encryption (E2EE) protocols.
• Deploy DDoS attacks, packet flooding, or any action that imposes an unreasonable load on our infrastructure.
• Attempt SQL injection, Cross-Site Scripting (XSS), API manipulation, or exploit zero-day vulnerabilities.
• Use automated scripts, bots, spiders, or crawlers to interact with our UI or unauthorized API endpoints.
• Attempt to access the admin panels, unauthorized databases, or other users' encrypted chat data.

Consequences and Legal Action:

If we detect any attempt to hack, probe, or maliciously exploit noxyai.com, dev.noxyai.com, dino.noxyai.com, or any other subdomain, we will take immediate and severe action.

• Platform Action: We will instantly and permanently ban your account, IP address, and hardware MAC address, wiping your data without warning.
• Legal Action: We actively log security anomalies. We will report hackers to their Internet Service Providers (ISPs), local cybersecurity authorities, and pursue civil and criminal legal action to the fullest extent of the law, seeking financial damages for infrastructure costs and business interruption.

3. INTELLECTUAL PROPERTY: DO NOT COPY NoxyAI

NoxyAI invests heavily in our proprietary AI models, user interface (UI), user experience (UX), and codebase. All code, text, graphics, logos, button icons, images, audio clips, and software on NoxyAI are the exclusive property of NoxyAI.

Do Not Copy:

• UI/UX Cloning: You may not copy, clone, rip, or mimic the visual design, layout, CSS, or dashboard structure of noxyai.com or any of our sites to create a competing product.
• Reverse Engineering: You may not reverse engineer, decompile, or disassemble our client-side code, AI responses, or API structures on dev.noxyai.com to steal our system prompts, logic, or infrastructure architecture.
• Data Scraping: You may not scrape our website content or documentation for the purpose of training your own AI models or publishing it elsewhere.

Enforcement: If you copy our platform or attempt to pass off our UI, code, or APIs as your own, we will issue immediate Digital Millennium Copyright Act (DMCA) takedown notices to your hosting provider and pursue legal action for intellectual property theft.

4. USER ACCOUNTS, SECURITY, AND AGE RESTRICTIONS

• Age Requirement: You must be exactly 18 years of age or older to use NoxyAI, or the legal age of majority in your jurisdiction. By creating an account, you legally warrant that you meet this age requirement.
• Account Security: You are fully responsible for safeguarding your account. Because we use End-to-End Encryption, we cannot recover lost chat data if you lose your credentials. We strongly advise enabling Two-Factor Authentication (2FA).
• Third-Party Auth: We utilize Google and Microsoft Auth. You are responsible for maintaining the security of those parent accounts.
• One User Per Account: Accounts are personal. You may not share, sell, or transfer your NoxyAI account or dev.noxyai.com API keys to another individual.

5. API USAGE TERMS (dev.noxyai.com)

Developers using dev.noxyai.com are subject to the following strict operational rules:

• Rate Limiting: You must respect the API rate limits assigned to your tier. Attempting to bypass rate limits by creating multiple accounts is a breach of these Terms.
• Zero Storage Guarantee: As stated in our Privacy Policy, we do not store API requests or responses. You are solely responsible for logging and managing your own API data on your end.
• Prohibited Use Cases: You may not use our API to generate illegal content, CSAM, malware, spam, hate speech, or content designed to deceive others (such as deepfakes or impersonation bots). We reserve the right to revoke API keys instantly if we suspect our models are being used for malicious purposes.

6. SUBSCRIPTIONS, PAYMENTS, AND REFUNDS

NoxyAI offers premium services and API access requiring payment.

• Payment Processors: We use PayPal and PayU (including PayU.in) for secure transactions. By making a payment, you agree to their respective Terms of Service.
• Refund Policy: For full, detailed information regarding our refund rules, subscription cancellations, and payment disputes, please visit noxyai.com/refund. By making a purchase on our platform, you explicitly agree to the refund conditions outlined on that page.
• Payment Fraud: Using stolen credit cards or initiating fraudulent chargebacks will result in an immediate permanent ban and reporting to relevant financial authorities.

7. DISCLAIMER OF WARRANTIES & AI LIMITATIONS

"AS IS" Basis: NoxyAI, including all subdomains (dino.noxyai.com, dev.noxyai.com, etc.), is provided on an "AS-IS" and "AS-AVAILABLE" basis. We do not warrant uninterrupted or error-free operation.

• AI Hallucinations: Artificial Intelligence can make mistakes, hallucinate facts, or provide illogical code.
• You agree that NoxyAI is a tool to assist you, not an infallible source of truth.
• You must verify all information, especially regarding medical, legal, financial, or critical coding matters.
• NoxyAI is not liable for any damages, lost profits, ruined codebases, or business failures resulting from your reliance on the AI's output.

8. ACCOUNT TERMINATION

We reserve the ultimate right to terminate or suspend your account, API access, and access to all subdomains immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

Upon termination, your right to use NoxyAI will cease immediately, and your encrypted data will be slated for permanent deletion in our Supabase databases.

9. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Government of India, specifically aligning with the Information Technology Act, 2000, without regard to its conflict of law provisions.

Any legal dispute, hacking incident, or intellectual property theft arising from the use of noxyai.com or its subdomains shall be subject to the exclusive jurisdiction of the competent courts within India.

10. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the platform following the posting of revised Terms means that you accept and agree to the changes.
